SERVICE AGREEMENT

CUSTOMER ACCEPTANCE: By signing this form, clicking “Accept,” paying for service, or activating devices in Barn Owl HQ, I agree that:

 

  • My "Agreement" with Barn Owl Tech, Inc. (“Barn Owl”) includes (a) this Service Agreement; (b) Barn Owl’s Billing Policy; (c) Barn Owl's Terms and Conditions; and (d) any terms specific to my Annual Plan, Prepaid Plan, or Flex Plan. I am committing to an Annual Plan, Prepaid Plan, or Flex Plan in accordance with Barn Owl’s Billing Policy.
  • Prepaid Plan Prices: The prices you pay, including device fees, activation fees, monthly access fees, data fees, prices for additional data usage, prices for SMS usage, software service fees, and other service fees may depend in part on how long—the minimum term—you’re agreeing in advance to do business with us.
  • Taxes And Surcharges We Don’t Set. You agree to pay all taxes, surcharges, and fees set by the government. We may not always give advance notice of changes to these items. If you’re exempt from some taxes, we need your exemption certificates.
  • Service Activation / Billing Cycle. Billing cycles start when the Service Agreement is accepted and paid.
  • Cancellation and Return Policy: You can cancel (if you’re a new customer) without additional fees if you tell us (and return to us in good condition any camera you got from us with your new service) WITHIN 45 DAYS of acceptance. You’ll still be responsible through that date for any service used during that period. 
  • Termination Fees And Your Rights To Change Or End This Agreement. Flex Plan and Prepaid Monthly Plan customers are NOT subject to Termination Fees. For Annual Plan and Prepaid Annual Plan customers, except as explicitly permitted by this agreement, you must maintain service with us for your minimum term, 12 months, plus any additional time required by any promotions you accept. IF YOU END YOUR SERVICE SOONER, OR WE TERMINATE YOUR SERVICE FOR GOOD CAUSE, YOU MUST PAY UP TO $30 PER CONNECTION AS AN EARLY TERMINATION FEE. Periods of suspension of service don’t count toward any minimum term. After your minimum term, Prepaid Plans will automatically renew in accordance with our billing policy. You can edit your billing plan, including switching to a Prepaid Annual Plan, Prepaid Monthly Plan, or Flex Plan by changing it prior to the automatic renewal.
  • I understand I may be unable to switch to a different Plan or other service and that if I switch, I may be bound by my existing or an extended contract term (including early termination provisions and fees) and/or charged a migration fee of up to $30 per camera.
  • Our Rights To Make Changes. Your service is subject to our business policies, practices, and procedures, which we can change without notice. WE CAN ALSO CHANGE PRICES AND ANY OTHER TERMS IN THIS AGREEMENT AT ANY TIME BY GIVING YOU WRITTEN NOTICE PRIOR TO THE BILLING PERIOD IN WHICH THE CHANGES WOULD GO INTO EFFECT. IF YOU CHOOSE TO USE YOUR SERVICE AFTER THAT POINT, YOU’RE ACCEPTING THE CHANGES.
  • Paperless Billing. Billing is processed paperlessly through Barn Owl’s software application. I waive any right to paper bills or notices. Billing invoices are available in the Barn Owl software application.
  • Documentation: I can obtain copies of Barn Owl’s Terms and Conditions and my Annual Plan-specific terms in the Barn Owl software application, or by contacting Customer Service at support@barnowl.tech or (720) 594-3649. I have received and read my Agreement.
  • Disputes. Barn Owl requires ARBITRATION of disputes. See Barn Owl's Terms and Conditions for details.
  • I authorize Barn Owl to obtain information about my credit history and to share that information with credit reporting agencies. If I am signing on behalf of a company, I am authorized to sign. Barn Owl can collect amounts due directly from me without first proceeding against the company.
